1. Agreement to Receive SMS Messages

By providing your mobile phone number and checking the SMS consent box on our contact form, you expressly consent to receive text (SMS) messages from Klickos at the phone number you provided.

2. Types of Messages

You will receive SMS messages that may include:

  • Appointment scheduling and reminders - Confirmations, upcoming appointment notifications, and follow-ups
  • Service updates - Project status updates, website launch notifications, and important account information
  • Support communications - Responses to your inquiries and technical support
  • Promotional messages - Special offers, discounts, company news, and marketing content
  • Automated message flows - Including but not limited to appointment reminders and follow-up sequences

Messages may be sent using automated technology.

3. Message Frequency

Message frequency varies and depends on your interaction with our services. You may receive:

  • Multiple messages per week during active projects or appointment scheduling
  • Occasional promotional messages
  • Automated message sequences (e.g., appointment reminders, follow-ups)

There is no fixed maximum number of messages per month, as frequency depends on your service usage and communication needs.

4. Standard Charges Apply

Message and data rates may apply. You are responsible for any charges from your mobile carrier for receiving SMS messages. We do not charge for sending messages, but your carrier's standard messaging rates will apply. Please contact your mobile carrier for details about your messaging plan.

5. Supported Carriers

Our SMS service is available on major carriers including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Service may not be available on all carriers. Check with your carrier for availability.

6. How to Opt-Out (Stop)

You can opt-out at any time. To stop receiving SMS messages from us:

  • Text "STOP" to any message you receive from us
  • Reply "STOP", "UNSUBSCRIBE", "CANCEL", "END", or "QUIT" to any SMS message
  • Contact us directly at [email protected] or +310628087290 and request to be removed from SMS communications

After you opt-out:

  • You will receive one final confirmation message that you have been unsubscribed
  • You will no longer receive SMS messages from us
  • You may still receive essential service-related communications via email
  • Opting out does not affect your subscription or services

Important: Opting out of SMS does not cancel your website subscription. To cancel your subscription, follow the process outlined in our Terms and Conditions.

8. Privacy and Data Use

10. Consent is Not a Condition of Purchase

Consenting to receive SMS messages is not required to purchase our services. However, opting in to SMS allows us to communicate with you more effectively about your project, appointments, and updates. You can still use our services if you choose not to receive SMS messages.

11. Message Delivery and Availability

11.1 No Guarantee of Delivery

While we make reasonable efforts to deliver messages promptly, we do not guarantee:

  • Delivery of all messages
  • Delivery within a specific timeframe
  • Message delivery during carrier outages or service disruptions

11.2 Service Availability

SMS service may be interrupted due to:

  • Mobile carrier issues or outages
  • Technical problems with our SMS provider
  • Your device being off or out of range
  • Network congestion
  • Your carrier blocking or filtering messages

We are not responsible for any delays, failures, or inability to deliver messages.

12. International Messaging

12.1 Supported Regions

Our SMS service is available to phone numbers in:

  • United States
  • Canada
  • European Union countries
  • Other regions may be supported - contact us to confirm

12.2 International Rates

If you are located outside the United States, international messaging rates from your carrier may apply. We are not responsible for any international charges from your mobile carrier.

13. Prohibited Uses

When communicating with us via SMS, you may not: 

  • Use abusive, threatening, or harassing language toward our staff
  • Send malicious links, viruses, or harmful content 
  • Impersonate another person or entity 
  • Violate any applicable laws 

Violation may result in immediate termination of SMS services and/or your subscription.

14. Modifications to SMS Terms

We reserve the right to modify these SMS Terms at any time. Changes will be effective immediately upon posting. We will notify you of material changes via:

  • SMS message to your registered phone number
  • Email to your registered email address
  • Notice on our website

Your continued participation in our SMS program after changes are posted constitutes acceptance of the modified terms.

15. Termination of SMS Service

We reserve the right to terminate SMS services to you at any time for:

  • Violation of these SMS Terms
  • Abusive or inappropriate conduct
  • Technical issues or security concerns
  • Any reason at our sole discretion

Termination of SMS services does not automatically cancel your website subscription.

16. Disclaimers and Limitations

16.1 "As-Is" Service

Our SMS service is provided "as-is" without warranties of any kind, express or implied. We do not warrant that:

  • Messages will be delivered reliably or on time
  • The service will be uninterrupted or error-free
  • Messages will be secure or private

16.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM:

  • Delayed, failed, or undelivered messages
  • Loss of data or information
  • Unauthorized access to your messages
  • Carrier charges or fees
  • Any other matter related to SMS services

Our total liability for SMS-related claims shall not exceed $50 USD/EUR.

16.3 Security Notice

SMS messages are not encrypted end-to-end. While we take reasonable security measures, SMS is not a completely secure communication method. Do not send sensitive financial information, passwords, or highly confidential data via SMS.

17. Compliance and Legal

17.1 TCPA Compliance (US)

Our SMS program complies with the Telephone Consumer Protection Act (TCPA) and related regulations. We obtain express written consent before sending SMS messages.

17.2 CTIA Guidelines (US)

We follow the CTIA Messaging Principles and Best Practices for responsible messaging.

17.3 ePrivacy Directive (EU)

For EU subscribers, we comply with the ePrivacy Directive regarding electronic communications and obtain appropriate consent.

17.4 GDPR (EU)

EU subscribers have rights under GDPR, including the right to access, correct, or delete their data. See our Privacy Policy for details.

17.5 CASL (Canada)

For Canadian subscribers, we comply with Canada's Anti-Spam Legislation (CASL) and obtain express consent.

18. Governing Law

These SMS Terms are governed by the laws of the Netherlands and are subject to the dispute resolution provisions in our main Terms and Conditions.

These SMS Terms are supplemental to and should be read in conjunction with our main Terms and Conditions. In case of any conflict, these SMS Terms govern matters specifically related to SMS communications.
